CHARLESTON -- A former human resources professional is suing after his employer allegedly failed to pay his final check in a timely manner.
Mark A. Toor filed suit June 25 in Kanawha Circuit Court against the West Virginia Higher Education Policy Commission.
According to the complaint, Toor worked for the defendant as vice chancellor for human resources resources from Jan. 2, 2013, until his resignation May 2, 2014. The defendant had a duty to pay the plaintiff's final check no later than May 15, but the defendant failed to pay the wages, including out-of-pocket reimbursements, until after May 15, the suit states.
The defendant is accused of violating the Wage Payment and Collection Act.
Toor is seeking damages, fees and costs. He is represented by Charleston attorneys Todd S. Bailess and Joy B. Mega of Bailess Law PLLC. The case has been assigned to Circuit Judge Paul Zakaib.
