HUNTINGTON -- A woman is suing after allegedly discovering a camera while using the changing room at a Barboursville clothing retailer.
A plaintiff identified only as A.F. filed suit June 10 in Cabell Circuit Court against Johnathan Roberts and American Eagle Outfitters Inc.
According to the complaint, on June 10, 2013, the plaintiff was shopping at the store at 404 Mall Road, Barboursville, and was changing into a bikini in the store's private dressing room when she noticed a recording device close to her body. Roberts was acting in his capacity as a supervisory employee at the time and, following the incident, fled the scene, the suit states.
Due to a gross lack of supervision of Roberts by the corporate defendant, other women have been victimized in a similar manner, and it is believed images of other females in various states of undress were retrieved from the recording device by law enforcement, according to the filing.
Because of the incident, the plaintiff has suffered anxiety, humiliation, annoyance, inconvenience, emotional distress, pain and suffering, loss of her ability to enjoy life and healthcare expenses.
The plaintiff is seeking damages in excess of the minimum jurisdictional limit.
