HUNTINGTON – The parents of a student allegedly injured during gym class are suing.
Randy Kisor and Tammy Kisor, individually and as the parents of Tanner Lee Kisor, a minor, filed suit June 11 in Cabell Circuit Court against Sherry Eling, as parent of Andrew Eling, a minor, and the Cabell County Board of Education.
According to the complaint, on Dec. 5, Tanner Lee Kisor and Andrew Eling were in the Cabell Midland High School gymnasium when Eling struck Kisor in the left eye with a ping-pong paddle, causing permanent vision loss.
At the time of the incident the gym teacher was not present, which is a breach of his duty, the suit states.
The defendants are accused of negligence, omissions, failure to act, negligently allowing students to participate in unsupervised activities and failing to discipline students.
The Kisors are seeking damages to adequately compensate them for injuries, plus interest and costs.
They are represented by Huntington attorney R.R. Fredeking II of Fredeking & Fredeking Law Offices LC. The case has been assigned to Circuit Judge Christopher D. Chiles.
