CHARLESTON – A man has filed suit against the driver whom he alleges struck him while he was sitting in traffic.
Timothy Barker alleges he was driving east on MacCorkle Avenue in South Charleston on Aug. 22, 2012, when defendant Randall Byrnside, who was driving a truck for defendant Putnam Aging east on the same road, struck Barker's vehicle while Barker was stopped in traffic.
Due to the collision, Barker suffered serious and permanent injuries, experienced great pain of his body and mind and incurred medical costs, according to the complaint filed Aug. 22 in Kanawha Circuit Court. He also lost his enjoyment of life and lost wages, the suit states.
In his complaint, Barker is seeking compensatory damages within the jurisdictional limits of the court, plus interest and costs.
