CHARLESTON – A man alleges he incurred medical costs when a driver struck him as he was standing outside his parked vehicle.
Shawn Williams alleges he was standing outside of his parked vehicle on the berm of MacCorkle Avenue in Charleston on Sept. 7, 2012, when defendant Lynn Rasmussen, who was driving on the same road, struck him.
In addition to his medical costs, Williams lost wages, endured physical and emotional pain and suffering and endured annoyance and inconvenience, according to the complaint filed Aug. 25 in Kanawha Circuit Court.
He also lost his capacity to enjoy life while his wife lost his consortium, the suit states.
At the time of the collision, Rasmussen was driving for defendant DL Peterson Trust. As a result, it is liable for her actions, the complaint says.
In his complaint, Williams seeks compensatory damages, plus costs, expenses, attorney fees and other relief the court deems just.
