Newspaper company seeks repayment of debt

HUNTINGTON – The Kanawha-Putnam Ad Mailer has filed a suit against Preferred Mail Advertising, alleging it has failed to pay nearly $80,000 for services rendered.

Parkersburg Newspapers, which published the Kanawha-Putnam Ad Mailer, alleges it contracted with defendant Preferred Mail Advertising to distribute preprinted advertising into the ad mailer.

Occasionally, the Preferred Mail ads included wraps, which had to be inserted into the ad mailer by hand, according to the complaint filed Aug. 26 in Cabell Circuit Court. In turn, Parkersburg Newspapers charged extra for any wraps that were to be inserted into the paper, the suit states.

Since the beginning of the contract, Preferred Mail has been billed $169,510.25, the complaint says. However, the company has only paid Parkersburg Newspapers $90,000, according to the complaint.

"Preferred Advertising has refused to pay its balance due of $79,510.25," the suit states.

Parkersburg Newspapers says Preferred Advertising has breached its contract with the company and has been unjustly enriched.

In its complaint, Parkersburg Newspapers seeks the money it says it is owed, plus pre- and post-judgment interest and other relief the court deems just.

Russell D. Jessee of Steptoe & Johnson in Charleston and Anders W. Lindberg of Steptoe & Johnson in Huntington will represent Parkersburg Newspapers.

Circuit Judge Chirstopher D. Chiles has been assigned to the case.
