MOOREFIELD – A Nebraska corporation claims it is owed tens of thousands of dollars in unpaid rent.
Axis Capital claims defendant Culinary Advantage doing business as Fox's Pizza entered into a lease agreement with Axis on Nov. 23, 2011. As part of the agreement, Fox's Pizza agreed to make monthly payments of $1,215.94, according to the complaint filed Sept. 17 in Hardy Circuit Court.
On Dec. 16, 2011, Fox's Pizza entered into a second lease agreement with Axis, promising to pay $824.29 for 60 months, the suit states.
However, the pizza company failed to make any of the payments after Sept. 4, 2013, according to the complaint.
"After applying all credit, deductions and charges the defendant remains indebted to Axis, in the principal amount of $84,941.25, plus interest at the statutory rate of 7 percent per annum from Sept. 4, 2013, plus costs," the suit states.
In addition to the money it claims it is owed, Axis is seeking post-judgment interest, costs, attorneys' fees and other relief the court deems just.
