Woman blames Wal-Mart for broken knee cap

KEYSER – A woman has filed suit against Wal-Mart, alleging she was injured when she slipped and fell at the store.

Margaret I. Smith claims she was shopping at the Keyser Wal-Mart on Sept. 11, 2013, when she slipped and fell on an unsafe rug on the floor in the front of the customer service department.

Due to her fall, Smith suffered serious, painful and permanent injuries, including a fractured knee cap, and became sick, sore and disabled, according to the complaint filed Sept. 10 in Mineral Circuit Court. She also incurred medical costs and suffered physical and emotional pain and suffering, the suit states.

Wal-Mart negligently failed to warn of hazards on its premises, failed to follow properly accepted practices to make the area safe, failed to exercise due care and created a hazardous condition, according to the complaint.

In her complaint, Smith seeks an unspecified judgment, plus pre- and post-judgment interest and other relief the court deems just.
