Boone Co. woman says mine damaged her property

MADISON – A Boone County woman is suing over claims her property was damaged by nearby mining operations.

Patricia Walker filed a lawsuit Sept. 22 in Boone Circuit Court against Coal River Mining, Loadout and Covington Coal Company, citing negligence.

According to the complaint, the defendant companies own and operate a mountaintop removal mine near Ashford/Nellis and began using explosives to blast through bedrock near Walker's property on Fork Creek Road in Nellis in October 2012, causing the property and home to experience cracking and subsidence.

Walker says she has accrued expenses to repair her home and her property has experienced a decrease in value.

The defendants are accused of negligence and private nuisance. Walker seeks punitive damages, interest, costs and attorney fees.

She is represented by attorneys John H. Skaggs of The Calwell Practice in Charleston and G. Patrick Jacobs of The Law Office of G. Patrick Jacobs in Charleston. The case has been assigned to Circuit Judge William S. Thompson.
