FAYETTEVILLE – A Calhoun County couple is suing over claims their vehicle was driven off the road when an ambulance allegedly nearly caused a collision changing lanes.
Teresa and Holly D. Starcher filed a lawsuit Sept. 24 in Fayette Circuit Court against Jan-Care Ambulance of Raleigh County Inc. and Charles A. Messenger, citing negligence.
According to the complaint, Teresa Starcher was a passenger in a car driven by her husband Holly on Interstate 79 in Monongalia County on July 6, 2013, when a Jan-Care ambulance driven by Messenger attempted to merge into the Starcher's lane, forcing Holly Starcher to steer the vehicle off the road into a ditch.
The Starchers say Teresa sustained injuries to her head, neck, chest and knee, Holly injured his back and knee, and they incurred the loss of their vehicle in the amount of $4,000. The complaint states Messenger admitted he was talking to his partner at the time of the incident and did not see the Starchers' vehicle before merging, and he is accused of negligence.
The Starchers are represented by attorney Ginny Conley of Conley Law Office in Parkersburg. The case has been assigned to Circuit Judge Paul M. Blake, Jr.
