NEW CUMBERLAND – A company is suing over claims it hasn't been paid for work and services rendered to a Weirton country club.
H.E. Neumann Company filed a lawsuit Oct. 10 in Hancock Circuit Court against the Williams Country Club.
According to the complaint, on Feb. 5, 2009, the plaintiff and defendant entered into a written contract wherein the plaintiff would perform services related to HVAC and plumbing trades and provide labor and materials on the defendant's property in Weirton. The plaintiff says it performed the work and provided materials outlined in the contract, but the defendant has failed to pay the more than $45,800 owed for its services.
The complaint states H.E. Neumann caused a mechanic's lien to be filed April 10, 2014, to secure the payment of more than $41,000.
H.E. Neumann seeks the balance owed plus interest and attorney fees, or the sale of the property to satisfy the lien.
Williams Country Club has been sued twice already this year. In August, U.S. Foodservice Inc. claimed the country club owed nearly $70,000. In May, two bondholders sued the country club accusing it of a breach.
H.E. Neumann is represented by attorneys Michael G. Simon and Carl A. Frankovitch of Frankovitch, Anetakis, Colantonio & Simon in Weirton. The case has been assigned to Circuit Judge James P. Mazzone.
