Man says engineering company didn't pay him on time

RIPLEY – A man is suing over claims he was not paid all wages owed on time after his employment was terminated.

Daniel Metheny filed a lawsuit Oct. 7 in Jackson Circuit Court against Fox Engineering Inc. and Fox Engineering PLLC, citing the West Virginia Wage Payment and Collection Act.

According to the complaint, Metheny was employed by the defendants from 2004 until May 1, 2014. The complaint states he received wages on May 7 and May 21, both of which were late pursuant to the West Virginia Wave Payment and Collection Act which requires all wages to paid within 72 hours of termination.

Metheny says he also was not paid for eight hours worked during his last week with the company and was not paid for paid time off he'd accrued and not used.

Metheny is represented by attorney Walt Auvil of Rusen and Auvil in Parkersburg. The case has been assigned to Circuit Judge Thomas C. Evans III.
