Woman blames Gino's for injuries at Cross Lanes restaurant

CHARLESTON – A Kanawha County woman is suing over claims she was injured when she tripped on the threshold of a restaurant.

Melinda Nelson filed a lawsuit Sept. 24 in Kanawha Circuit Court against Better Foods Inc., citing negligence.

According to the complaint, Nelson was at the defendant's restaurant, Gino's Pizza and Spaghetti House in Cross Lanes on Sept. 24, 2012, when she tripped on a missing or improperly installed, designed, or maintained transition strip or threshold in the restaurant's doorway.

Nelson says she fell and sustained injuries to her wrist. The defendant is accused of failing to properly maintain the threshold, knowing that customers would be using it to enter and exit the restaurant.

Nelson seeks compensatory and punitive damages, interest, and attorney fees.

She is represented by attorney Paul S. Perfater of Myers and Perfater in Charleston. The case has been assigned to Circuit Judge Louis H. "Duke" Bloom.
