Ohio woman claims staffing company withheld pay

WHEELING – An Ohio woman is suing over claims her employer withheld funds from her pay.

Donna Vance of Belmont County filed a lawsuit Oct. 14 in Ohio Circuit Court against McClure Staffing and Fran Garey, citing the West Virginia Wage Payment and Collection Act.

According to the complaint, Vance was employed by McClure Staffing, at which Garey is an officer, from August 2008 to April 2009. Vance says the defendants withheld funds from her pay for sick days and time off in violation of the West Virginia Wage Payment and Collection Act.

The complaint states Vance's employment was terminated April 14, 2009, but she has yet to receive her final pay, which should include the money they have failed to pay her, totaling more than $700.

Vance seeks three times the amount owed in liquidated damages and attorney fees.

She is represented by attorney Bradley K. Shafer of Swartz Campbell in Wheeling. The case has been assigned to Circuit Judge Ronald E. Wilson.
