Bank says cabinet company owes $55K

MOOREFIELD -- A Hardy County bank is suing over claims a company is in default on loan payments.

Capon Valley Bank filed a lawsuit Oct. 22 in Hardy Circuit Court against Fertig Cabinet Company, Robert Fertig Jr. and Sue F. Williams.

According to the complaint, on June 3, 2013, Fertig Cabinet delivered to the plaintiff a $57,241 promissory note guaranteed by Fertig and Williams. Capon Valley Bank says the defendants are in default and have failed to cure the default, owing $55,054 plus interest at the rate of $9 per day.

The bank seeks the amount owed plus interest and attorney fees. It is represented by attorney James P. Geary II of Petersburg.
