MARTINSBURG – Martin & Seibert attorneys Susan Snowden and Jason Murphy recently facilitated a lecture at an education committee workshop of the Eastern Panhandle Organization Homeowners Association (EPOHOA).
The lecture focused on the legal rights and liabilities that impact HOA’s.
Snowden and Murphy presented the legal options available for the collection of delinquent homeowner assessments and resident’s rights pertaining to the collection of “community” debt. The seminar explained the different types of enforcement mechanisms that can be utilized by HOA’s to collect delinquent fees (including assessments), the recording of liens and the commencement of suits.
The seminar also discussed frequent pitfalls that can occur during the collection of delinquent dues, interest, and penalties, and promoted best practices. A portion of the seminar also discussed recent trends in West Virginia litigation that impact homeowners.
The education seminar was attended by more than 50 representatives including many local and regional homeowners associations.
