MADISON – A Julian woman has sued Pepsico and a store owner, alleging a cooler shelf crashed into her hand.
Regina Jarrell filed a lawsuit filed April 10 in Boone Circuit Court against Pepsico and Houchens Industries Inc.
According to the complaint, on May 10, 2014, Jarrell was getting a drink at the Houchens Save-a-Lot store in Danville and as she reached for a 20-ounce bottle of Diet Pepsi on the middle rack, the fully loaded top shelf crashed down on Jarrell's right wrist and hand. The suit says the incident caused Jarrell great pain and panic.
The lawsuit states a manager filled out an incident report that says that the "top rack of Pepsi cooler was not properly attached and fell on customer's wrist/lower portion of arm. Visible knot forming; bruising." The manager also informed Jarrell that a Pepsico worker had just restocked the shelf that fell, the suit says.
The plaintiff cites medical expenses, pain and suffering, mental anguish, emotional distress, inconvenience, annoyance and loss of enjoyment of life.
Jarrell seeks damages that don't exceed $75,000, plus court costs and attorney fees. She is represented by attorneys Charles M. Johnstone and Madeline G. George of Johnstone and Gabhart of Charleston.
