WHEELING – A girl allegedly injured when a grocery store shelf fell on her, through her guardian, has sued the store for damages.
Abegail Spaugy, through her guardian Micah Spaugy, filed a recent lawsuit in Ohio Circuit Court against Cabela's Wholesale Inc. and Cabela's Inc.
According to the complaint, on Aug. 5, 2013, the minor plaintiff and her guardian went to Cabela's in Triadelphia, and Abegail Spaugy was hit with falling shelving and merchandise due "to hazardous conditions permitted to exist on the defendants' premises, and sustained severe and disabling personal injuries."
The defendants are cited with: failing to properly inspect and maintain the premises; to correct a hazardous condition; not training their employees correctly; and not warning customers about a dangerous condition.
The plaintiff seeks damages in excess of the lower limit of the court's jurisdiction, pre- and post-judgment interest, attorney fees and costs. They are represented by attorney Carl A. Frankovitch of Frankovitch, Anetakis, Colantonio & Simon in Weirton.
