Putnam woman accuses car dealer of odometer fraud

WINFIELD – A Putnam County woman has sued a local car dealership for selling her a Lexus with an odometer allegedly rolled back.

Stacy Morris filed a lawsuit April 27 in Putnam Circuit Court against T.P. Chevrolet Inc.

According to the complaint, on Sept. 10, 2014, Morris says T.P. Chevrolet, doing business as Turnpike Chevrolet in Nitro, sold her a used car, a 2008 Lexus RX350, that had an odometer discrepancy as a result of a odometer roll back. When purchased, the disclosure form stated that the "actual mileage" was 12,216 miles, the suit states, but the vehicle's title history reveals that the Lexus has at least 36,555 miles.

Morris alleges the dealer knew of the higher mileage or should have discovered it in an inspection.

The plaintiff cites financial loss, damages mental distress, aggravation, anxiety, annoyance and inconvenience.

Morris seeks: cancellation of the contract; a declaratory judgment against the defendant; a permanent injunction ordering it to stop such unlawful acts and start a training program for employees; damages; pre- and post-judgement interest; attorney fees; and court costs. She is represented by attorneys Kristina Thomas Whiteaker and David L. Grubb of The Grubb Law Group in Charleston.
