LOGAN – A Maryland man who had to have three hernia operations, allegedly to correct the problems that came about from the first, is suing the doctor and hospital that oversaw the operations.
Jason Grazuties filed a complaint on May 1 in Logan Circuit Court against Dr. Michelle Mouria and Logan General Hospital.
On March 20, 2013, Grazuties received a left inguinal hernia surgery from Mouria, at which time Mouria allegedly "failed to utilize surgical technique consistent with accepted general surgery standards of care; and failed to place and secure mesh used to repair the hernia in the appropriate location," the lawsuit states.
Shortly after the procedure, the plaintiff suffered symptoms "consistent with continued hernia problems because the failed surgery" didn't repair the original problem, the lawsuit states.
In September 2013, he underwent a second left inguinal hernia surgery and the mesh placed by Mouria was not found, the lawsuit states. The pain continued and a "palpable mass" was still evident, according to court documents, so a third surgery was performed on Aug. 29, 2014.
As a result of these three procedures, the lawsuit states, the plaintiff experienced pain and suffering, scarring, medical expenses and a prolonged impairment and recovery period.
The plaintiff, citing negligence, recklessness, carelessness and deviation, seeks unspecified damages, plus costs. The plaintiff is represented by Tony L. O'Dell and Cheryl A. Fisher of Tiano O'Dell PLLC in Charleston.
