WEST UNION – A West Virginia construction company is suing to recover money it allegedly hasn't been paid for work it's done on a Doddridge County pipeline.
Pete Gould and Sons Inc. filed a complaint in Doddridge Circuit Court against MarkWest Liberty Midstream and Resources LLC; Midwest Liberty Midstream and Resources LLC; Sperry Hardwoods Inc.; Mark Vincent Schumacher; Mark Christopher Schumacher; Frederick E. Davis; Kimberly A. Davis; Craig D. Evans; Richard Millard Johnson; Roberta J. Martin; Samuel C. Hammett; Sherri L. Hammett; Robert E. Hammett; Jeremy W. Sutton; Amanda L. Sutton; Clarence Duane Evans; Joan P. Evans; Daniel K. Jozwick; Lisa A. Jozwick; Guss T. Kelley; and Merelene N. Kelley.
Gould, the lawsuit states, entered into a natural gas pipeline construction contract on June 19, 2014, with MarkWest for $10.48 million. For the money, Gould agreed to provide construction and installation of a steel pipeline in Doddridge County. But due to several alleged mistakes and oversights by MarkWest and the other defendants, the lawsuit states that of the invoices submitted, Gould has received payment of $1,328,591.52 but still is owed $4,377,504.77.
The plaintiff seeks the court to order the defendants to pay the remaining balance; to order the sale of all lienable property interests of the defendants; pre- and post-judgment interest; and costs.
