Molly Humphreys Aguilar vs. Christopher M. Roper, Scott Patrick Reagan, Charles C. Cole Sr., City of Shepherdstown Police Department

* Suit is to redress Aguilar's claim that Roper, Reagan and Cole, along with the police department, have violated her 1st, 4th and 14th Amendment rights. Charges stem from a Sept. 25, 2004, incident when Aguilar claims unlawful arrest, excessive force, unlawful retaliation, battery and outrage when police attempted to arrest her after an altercation with police. Aguilar is asking for attorney's fees to be paid, as well as, compensatory, actual and punitive damages, which will be decided at a jury trial.

Sunbelt Rentals vs. Ranson Retail, Home Depot USA Inc., Bank of America, RIV Construction Group, Red Rock Steel Erectors & Fabricators LLC

* Sunbelt Rentals claims Home Depot leased commercial and industrial equipment on March 27 for improvement to the Home Depot Store Lot 11 in the Potomac Marketplace Commercial Subdivision in Ranson. Sunbelt
claims the equipment was never returned resulting in breach of contract and is asking for $26,979.93 plus interest. In addition, Sunbelt has filed a mechanic's lien upon the real estate and is asking that Lot 11 be sold to satisfy lien. The company is also requesting attorney's fees of 33 1/3 percent plus court costs in post-judgment interest and other relief the court deems necessary.

Rebecca Sullivan vs. Jefferson County Board of
Education and Nel Glover, parent of minor
PA-Lawrence M. Schultz; J-Thomas Steptoe Jr.
* Sullivan is suing the Board of Education and Glover over a May 28, 2004, incident in which Glover's son allegedly propelled a rubber band at her son while in class at Harpers Ferry Middle School. Sullivan's son suffered severe and permanent damage to his right eye, including loss of normal sight. Sullivan is asking for $35,000 in medical, hospital and related expenses her son has incurred as a result of his injury.
