Injuries caused by intoxicated driver, suit claims

A woman claiming permanent injuries from an auto accident two years ago filed suit against the alleged intoxicated driver who caused the wreck.

Rebecca Elizabeth Dempsey filed suit against William Michael Niland, Jr. alleging he was intoxicated and under the influence of alcohol or "some other drug" when he struck her vehicle on U.S. Route 119 on July 2, 2004. She is seeking at least $50,000 in damages, plus punitive damages in the amount of at least 10 times the award for general and special damages.

The suit was filed June 27 in Monongolia County. Dempsey is represented by John C. Scotchel, Jr. of Morgantown.

Dempsey, who was driving a 2002 Lexus RX3, was struck by Niland's 2003 Honda Accord CP, according to the suit.

In addition to medical expenses, Dempsey claims she has been caused to suffer a reduction or impairment in her capacity to earn money and a diminution in her capacity to enjoy life in the future.

The lawsuit does not specify Dempsey's physical injuries.
