MORGANTOWN - The alleged victims of an automobile accident have filed a lawsuit against the man they say was too drunk to drive and the owner of the car he was driving.
Audrey and Jarret Friend filed suit Aug. 17 in Monongalia Circuit Court against Stevie Stephens and Amy Salisbury.
They say Stephens was too drunk to drive when he collided with Audrey Friend in her 1989 Dodge Lancer.
The incident took place at 4:37 p.m. on June 14, 2005.
"At said time and place, Defendant Stevie L. Stephens drove a 2004 Toyota Camry owned by Defendant Amy L. Salisbury in a negligent, grossly negligent, reckless and unlawful manner and violently crashed into the front end of the plaintiff's vehicle, thereby… causing Plaintiff Audrey Friend to suffer bodily injuries and personal injury damages," the complaint says.
The complaint adds that Stephen was under the influence of alcohol and possibly "other mind-altering substances."
The lawsuit says Jeremy Propps, Friend's son, has lost the services of his mother and is listed as a plaintiff.
The plaintiffs also seek compensatory damages for medical expenses, lost wages and income, lost earning capacity and other special damages.
Friend says she has sustained permanent injuries and is also seeking punitive damages.
