WVU sued over fight at football game

MORGANTOWN - A Monongalia County woman has filed suit against West Virginia University's Board of Governors over a parking lot fight at a football game.

Mary Murray says she was injured when the fight spun out of control and entered the lawsuit into Monongalia Circuit Court Sept. 1.

The alleged incident took place Sept. 4, 2004, at West Virginia's football game against East Carolina.

Murray says she noticed several male individuals shouting obscenities at each other and called 911 to "obtain police intervention, advising of a possible fight and riot."

However, she says no police showed up to stop the fight that eventually broke out.

"Plaintiff once again dialed 911 requesting police assistance when one of the male individuals, who appeared to have been actively involved in the physical altercation… charged in the direction of the plaintiff, and knocking her to the ground as he attempted to get to another male individual who was beyond the area of the plaintiff, thereby causing injury to her foot," the complaint says.

Murray claims to have suffered severe personal injuries, including pain and suffering, and that WVU had a duty to ensure the safety of the fans who attend football games.

William Lee Clark of Charleston is also listed as a defendant, though the complaint does not specify how he is involved.

Michelle Widmer of Widmer-Eby and Associates in Morgantown is representing Murray, who seeks compensatory damages for medical expenses, lost income, pain and suffering, mental anguish, emotional distress, permanent injury, annoyance, inconvenience, loss of earning capacity and loss of enjoyment of life.

She says she already has incurred $3,800 in medical expenses.

"The defendant, WVU, owed to Plaintiff a duty or reasonable care under the circumstances to provide her with a safe area to park and socialize," the complaint says.
