CHARLESTON - A St. Albans woman is suing the city and its municipal utility commission in Kanawha Circuit Court, claiming they are to blame for injuries she sustained in a fall.
Mildred White filed the suit Sept. 12 and added graphic pictures she says that are of her badly injured right leg.
She claims the cover on a water service meter was not properly secured when she stepped on it, causing it to tip and sending her leg under the ground.
"Defendants carelessly and negligently failed to secure the cover on a water service meter situated on the property of the plaintiff, pursuant to an easement for the location of said meter previously granted to the defendants," the complaint says.
The alleged incident took place June 6.
She says the slip of the cover caused "serious permanent and disfiguring injuries," and that she has already paid $6,000 in medical bills.
She is seeking compensatory damages for future medical bills, aggravation, annoyance and inconvenience, embarrassment and humiliation, scarring, disfigurement, mental anguish and physical pain and suffering.
Harvey Peyton, a Nitro attorney, is representing White.
Judge Charlie King has been assigned the case.
