* Resh claims the defendants violated Occupational Safety and Health Administration rules by ignoring safe excavation and construction practices, which led to the plaintiff being injured on Feb. 6, 2006, when he was working for the defendants as a pipe fitter in a ditch. Resh claims the defendants knew that the ditch was dangerous because of water accumulation, the lack of braces and the fact that previous sections of the trench had collapsed. Resh was knocked unconscious when a 3-foot chunk of frozen dirt fell and struck him on the head, leaving him totally and permanently disabled. He is seeking an amount of relief to be determined at trial.
