* Arbogast loaned the Brackettes over several months a total of $348,000 with the promise of repayment. Arbogast claims the loans were actually part of a "scheme" divised by the Brackettes. He believes the money that was "loaned" was used to purchase property of 35.386 acres of land in Shepherdstown. He is claiming breach of contract, fraudulent misrepresentation, fraud and civil conspiracy.

* On Aug. 21, 2006, Douglass Chester Holden was served alcohol at DIVAS before operating his Ford Explorer. That same evening, the Explorer driven by Holden collided with a vehicle driven by John Bennett. As a result of the collision, John Bennett was killed. Anne Bennett claims that DIVAS' employees continued to serve Holden alcohol who was intoxicated. She is claims dram shop, negligent supervision, wrongful death and survival claims. She is seeking compensatory, general and punitive damages against DIVAS.
