Farmers and Mechanics Mutual Insurance Company of West Virginia v. Joseph Estevez and Jessica Gauvin

* On Oct. 25, 2006, Estevez and Gauvin were cooking using the stove top and left it unattended in the duplex they rented. The stove caught on fire damaging the duplex. The duplex is owned by Ralph Hofer and was insured by Farmers and Mechanics. The duplex sustained damage in $103,878. The insurance company is seeking the amount of damage, with pre- and post-judgment interest.

* On Jan. 4, 2007, Pond offered to sell the Fluhartys a parcel of land at 69 Dogwood Trail, Harpers Ferry. The Fluhartys claim that prior to the sell Pond misrepresented facts about the property and building to them. Nancy McBride had suggested the Fluhartys contact Countrywide for a loan. The Fluhartys also claim she provided them with incorrect information about the property as well. Countrywide had used Kirk McBride, son of Nancy, to do the appraisal of the home, which the Fluhartys claims was wrong and misleading. They also claim Countrywide was to oversee the loan process. They were unaware they were purchasing a mobile home. Pond purchased an owners title insurance policy from Stewart Title with Golden and Amos as insurance agents for the transaction. The Fluhartys are claiming against Pond are: misrepresentation, fraud and breach of contract; against Nancy McBride: breach of contract; against Kirk McBride: breach of contract; against Countrywide: fraud, joint venture, conspiracy and agency, negligence, breach of contract; against MRES: misrepresentation; against Golden and Amos: breach of contract and negligence; against Stewart Land Title: breach of contract, negligence. They are seeking that cancel the sale under the deed of trust, be assessed damages, compensatory and punitive.

Barbara L. Baker and George L. Baker v. Delhaize America Inc. dba Food Lion and Food Lion LLC
PA-Harry P. Waddell; J-Gina Groh
* On Oct. 26, 2007, Baker was a patron of the Shepherdstown Food Lion. She slipped in a puddle of water, which resulted in injuries. She is seeking a judgment in an amount that will be determined at trial.
