Cesar Seminario v. Kirk Robinson and United Services Automobile Association and Nationwide Mutual Fire Insurance Company

* On Feb. 24, 2007, Seminario was a passenger in operated by his wife, Nelly, but owned by Antonio Jorge Hori. While driving on W.Va. 9, Robinson crossed the center line striking the vehicle Seminario was a passenger in. He suffered injuries that resulted in lost wages and his capacity to work. Robinson's insurance company, Integon Casualty Insurance Company has denied all claims. United States Automobile Association that carried the insurance on the car he was a passenger also denied his claims as well as Seminario's own insurance company, Nationwide Mutual. He is seeking compensatory damages from each party for his injuries ads well as prejudgment interest as well as any further relief as the nature of his cause may require.

She is seeking compensatory damages from each party, prejudgment interest on all items ascertainable pecuniary loss up to the date of the trail as well as post-judgment interest and attorney's fees.

* Luttrell is the son of Mary Adalee Lutrell and was her medical power of attorney. Mary Adalee Lutrell was a resident patient at Canterbury and under their care. Because of her age and medical condition she was at a high risk of falling and suffering serious injury. Paul Luttrell claims the home was aware of that. On June 3, 2006, an alarm to make the nurse's station aware she was attempting to leave her bed was intentionally disabled. That morning Mary Adalee left the bed and fell. Her son claims she was left to lie in her own blood for an unknown length of time. She died on June 6, 2006, as a result from injuries sustained during the fall. Her death was not reported to the state, however, they were notified later and Department Health and Human Services State Board of Licensure conducted an investigation. He is claiming wrongful death, violation of W.Va. Code 16-5C-15, intentional misconduct and caregiver abuse, outrage, civil conspiracy, violation of code of state rules, negligence, negligent employment and supervisory practices and professional liability. Paul Luttrell is seeking a sum as a jury many deem appropriate for past medical expenses, funeral and burial expenses, pain and suffering, emotional distress, lost wages, consequential and incidental damages, general and special damages, punitive damages, court costs, attorney's fees and costs.
