CHARLESTON - The husband of a woman killed in a motor accident with a Krispy Kreme doughnut truck has filed a suit on behalf of her estate.
Tracy Bowen filed a suit March 17 in Kanawha Circuit Court on behalf of the estate of Stacy Jean Dickey Bowen. The suit is against Krispy Kreme and Ronald Guy Underwood II.
According to the suit, Underwood was driving a 2004 Chevrolet truck on March 1, 2008, when he struck Bowen on Interstate 64 near Dunbar. Bowen was driving a 2000 Toyota Celica.
Bowen died as a result of the collision.
Bowen is survived by her husband and a 22-year-old daughter, Whitney Dickey. According to the suit, Tracy Bowen and Dickey claim they have suffered sorrow, mental anguish and loss of solace, including society, companionship, comfort, guidance, kindly offices and the advice of their relative.
Tracy Bowen claims he suffered funeral and burial expenses as a result of the crash.
According to the suit, Bowen seeks compensatory and punitive damages.
Attorney Harold S. Albertson, Jr. is representing Bowen. The case has been assigned to Judge Irene Berger.
