Martinsburg woman sues after slipping on apple sauce in grocery store

MARTINSBURG – A Martinsburg woman has filed suit against a grocery store, alleging she was injured after she slipped on apple sauce.

Ann P. Moats claims there was apple sauce left on the floor of the Martinsburg Weis Markets after an employee had cleaned up a broken jar on Sept. 25, 2006.

She claims she slipped on the apple sauce and suffered bodily injury, physical impairment and physical and mental pain, according to the lawsuit filed Sept. 18 in Berkeley Circuit Court.

Moats was responsible for medical costs, the suit states.

She claims Weis Markets was negligent because even though it knew the apple sauce was in the aisle, it failed to warn its customers.

Moats is seeking compensatory damages not to exceed $74,500, pre- and post-judgment interest and costs.

She is represented by Harry P. Waddell of Martinsburg.
