Rose, Berger recommended for federal posts

CHARLESTON -- West Virginia Senators Robert Byrd and John D. Rockefeller IV have recommended Charleston lawyer Herschel "Ned" Rose II and Kanawha Circuit Judge Irene Berger to two federal judgeships.

Rose was a former tax commissioner.

Also nominated for one of the federal judgeship spots in 2007 was Martinsburg lawyer William Powell, but the Senate never confirmed his nomination.

Presidents nominate judges, but they usually follow their party's senators' recommendations.

If nominated, Berger would replace U.S. District Judge David Faber, who is in semiretirement. Rose would replace U.S. District Judge Craig Broadwater, who died in 2006.
