CHARLESTON – A Braxton County couple is suing General Motors Corporation, claiming they got a lemon of a vehicle and the company refused to rectify the situation.
Karis Drake and Kay Drake filed their lawsuit March 19 in Kanawha Circuit Court.
They say they bought a new GMC Canyon on March 12, 2008 from Pletcher Pontiac Company.
The lawsuit says they paid $25,890 for the vehicle, which did not include state sales tax and getting the vehicle registered and licensed.
From the outset, the couple says they had problems with the vehicle that impaired its use and market value. Plus, the couple says they were afraid the drive the vehicle in its condition.
They tried to get the vehicle repaired, but the repairs were unsuccessful, the lawsuit says.
General Motors has refused to give the couple a refund or give them another vehicle or comparable value, the complaint says.
The couple is seeking damages for their loss of the use of the vehicle, annoyance, inconvenience and their costs of getting alternative transportation.
They also want a full refund of the sales price they paid, plus costs associated with the sales tax, license and registration.
