Woman sues dealership after man falls on her

HUNTINGTON – The lack of a handrail on some steps at a Cabell car dealership is to blame for a man falling on top of a woman and injuring her, according to a lawsuit.

Dona Gothard filed a complaint March 30 in Cabell Circuit Court against Tri-State Chrysler Jeep.

Gothard claims she was a customer at the dealership on March 30, 2007 when another person, Mike Cagle, fell on top of her on some steps.

In her complaint, Gothard says the lack of the handrail is a violation of safety code and that the dealership had a duty to keep a safe premises.

Gothard says that as a result of the incident, she's been left with permanent bodily injuries and has incurred medical expenses.

The plaintiff is seeking compensatory and punitive damages.

Richard W. Weston is representing Gothard. The case is before Cabell Circuit Judge F. Jane Hustead.
