Woman sues after man jumps tracks, crashes into home

WAYNE COUNTY – A woman says her home suffered extensive damages after a drunken man jumped two railroad tracks and crashed into it.

Rose DeVaney filed a lawsuit July 13 in Wayne Circuit Court against Timothy Gatwood.

DeVaney claims Gatwood rammed a 1996 Chevrolet 1500 pickup truck into the front of her home while he was drunk on Oct. 2 at about 3:30 a.m.

"Plaintiff violated a host of traffic laws when he plowed his pickup truck into the front of plaintiff's home, after exiting the road, and literally jumping two sets of railroad tracks to hit the same," the suit states.

After the incident, Gatwood was issued a citation for being under the influence of alcohol, the complaint says.

In the two-count suit, DeVaney is seeking compensatory and punitive damages, attorney's fees and costs, pre- and post-judgment interest and other relief the court deems just.

Timothy P. Rosinsky of Rosinsky Law Office in Huntington will be representing her. The case has been assigned to Wayne Circuit Judge Darrell Pratt.
