Lincoln woman says she's owed $25K in overtime

HUNTINGTON – A Lincoln County woman says Lincoln County Opportunity Company owes her more than $25,000 in unpaid overtime wages.

Olita Scites claims she began working for LCOC as a resource coordinator from 1993 until 1998. At that time, Scites worked as an hourly employee for her direct supervisor, Alice Tomblin. Even though Scites routinely worked more than 40 hours per week, she claims Tomblin told her LCOC does not pay any overtime wages.

"Accordingly, Ms. Tomblin instructed plaintiff not to submit any overtime hours on her 'Time Sheets' and 'Time Distribution Sheets,'" the suit filed Nov. 18 in U.S. District Court states. "Ms. Tomblin also instructed plaintiff that any hours she worked above and beyond 40 hours per week would be considered 'voluntary' time."

After she quit in 1998, Scites returned to work for LCOC in 2002, again as its resource coordinator. But again, her direct supervisor, Bill Carpenter, informed her she would not be paid for overtime.

When Scites began working in 2002, she earned $7 per hour. In 2005, she was given a raise to $9 per hour, the suit states.

On Aug. 15, 2008, Scites resigned from her job, according to the complaint.

Scites claims LCOC owes her for unpaid overtime hours she worked between 2002 and 2008.

"Plaintiff conservatively estimates, and herein asserts, an overtime wage claim of seven hours per week, at $13.50 per hour, for a weekly claim of $94.50," the complaint says.

In addition to the money she says she is owed, Scites is seeking liquidated damages, attorney's fees, interest and other relief the court deems just.
