Peirce firm plans to close shop in W.Va., attorney says

CHARLESTON -- Robert Peirce of Pittsburgh plans to wrap up his firm's asbestos litigation in West Virginia, his associate Robert Daley said at a Feb. 4 hearing.

"My goal is to clear this docket in two years," Daley told Circuit Judge Arthur Recht.

After that, he said, "The Peirce firm's business in West Virginia will be concluded."

Peirce filed about 1,600 suits in West Virginia against CSX Transportation, Norfolk Southern and Conrail.

About 60 claims of malignant disease remain active.

Recht has placed all non-malignant cases on an inactive docket.

Daley told Recht he would return 30 to 40 cases to the active docket.

Recht presides over asbestos cases by appointment of the mass litigation panel of the West Virginia Supreme Court of Appeals.
