Mount Hope woman sues Delta Airlines, Adam Travel Services for breach of contract

CHARLESTON -- A Mount Hope woman is suing Delta Airlines and Adam Travel Services after she claims they breached their contracts with her.

On March 13, 2008, Suzanne Sadat purchased airplane tickets from Adam Travel Services for herself and her three children, according to a complaint filed Feb. 9 in Kanawha Circuit Court.

Sadat and her children arrived at Yeager Airport on June 10, 2008, at about 5 a.m. By 5:30 a.m., her eight pieces of luggage had been checked in, according to the suit.

Sadat claims after the luggage was checked in, a Delta agent informed her she was not able to print boarding passes, but that Delta was trying to fix the problem. At 6:30 a.m., Sadat's luggage was removed from the plane because the problem still had not been fixed.

Delta informed Sadat she needed to contact Adam Travel Services because of the problem with her tickets and Delta could not re-issue the tickets because they were electronic and not paper tickets, according to the suit.

Sadat claims Delta told her she could take the next flight at 11:30 a.m. after she spoke with Adam Travel Services. She claims when she finally was able to contact the travel agency after five hours of trying, Adam Travel Services told her nothing was wrong with the tickets and that Delta had made an error.

Sadat claims a Delta agency told her they had arranged a reservation for a 1:30 p.m. Continental Airlines flight to JFK Airport in Washington, D.C., to catch her connecting flight, but when she returned they then informed her Continental Airlines could not check her bags through her connecting flight because it did not have an affiliation with her connecting flight's airline.

Sadat claims at Delta gave her tickets with her luggage checked only to Paris instead of all the way to her destination, but when she asked why, Delta said they could not check her luggage all the way for her. She claims Delta called security when she became distraught and began crying.

Sadat claims Delta and Adam Travel Services were negligent and breached their contracts with her.

Sadat is seeking compensatory and punitive damages. She is being represented by Anthony J. Majestro.

The case has been assigned to Circuit Judge Tod J. Kaufman.
