CHARLESTON -- A Dunbar man is suing Wal-mart after he claims he slipped and fell in its Nitro location.

On June 9, 2008, William Young was a customer at the Nitro store when he slipped in the dairy section of the store and fell to the ground, according to a complaint filed June 3 in Kanawha Circuit Court.

Young claim the defendant was careless and negligent in maintaining the floor in the store, which caused him to fall and be injured.

As a result of the defendant's negligence, Young suffered physical injury; pain and suffering; loss of enjoyment of life; annoyance and inconvenience; and loss of income, according to the suit.

Young is seeking judgment in an amount to be determined by a jury. He is being represented by Herbert L. Hively II.

The case has been assigned to Circuit Judge James C. Stucky.
