Cabell man blames nursing home for mother's death

HUNTINGTON -- A Cabell County man is suing Seventeenth Street Associates after he claims it is responsible for his mother's death.

Donna McNeely was a resident at the nursing home, which is doing busniess as Huntington Health and Rehabilitation Center, from July 17, 2008, until Aug. 18, 2008, and from Sept. 25, 2008, until Dec. 11, 2008, according to a complaint filed Oct. 1 in Cabell Circuit Court.

Larry McNeely claims his mother suffered from dehydration and malnutrition during her stay at Huntington Health and Rehabilitation Center, which ultimately led or contributed to her death on Jan. 10, 2009.

The defendant also failed to provide adequate hygiene to prevent Donna McNeely from developing a urinary tract infection, according to the suit.

Larry McNeely is seeking compensatory and punitive damages. He is being represented by Andrew L. Paternostro and Jeff D. Stewart.

The case has been assigned to Circuit Judge David M. Pancake.
