KM Associates sued for failure to pay more than $900,000 in debt

CHARLESTON -- KM Associates are being sued in nine separate lawsuits for failure to pay more than $900,000 for goods and services provided to it.

CNB Bank; Thistle Financial Group, LLC; Tri-State Roofing & Sheet Metal of West Virginia; and Brewer & Company of West Virginia, Inc., were also named as defendants in seven of the nine suits.

The plaintiffs are Robinson & Son Plumbing and Heating, Inc.; South Charleston Electric Company, Inc.; South Charleston Electric Company, Inc.; Thermal Solutions, Inc.; Prizm Painting, LLC; RC General Contractors, Inc.; Rock Branch Mechanical, Inc.; Associated Architects, Inc.; and Agsten Construction Company, Inc.

The plaintiffs were contractors for the defendants on a construction project and performed all contractual obligations pursuant to their contracts, according to nine complaints filed Sept. 7 in Kanawha Circuit Court.

The plaintiffs made reasonable attempts to collect the amounts due by the defendants for the construction project, however, the defendants failed and refused to pay the plaintiffs, according to the suits.

The nine plaintiffs claim when the defendants would not pay the amounts due, they filed notices of Mechanic's Liens against the defendants.

Despite the Mechanic's Liens, the defendants continued to fail and refuse to pay the amounts due, according to the suits.

Thermal Solutions, Inc., and Prizm Painting, LLC, were the plaintiffs to only name KM Associates, LLC, as defendants in the suit.

The plaintiffs are seeking judgment in the total amount of $925,356.99 with pre- and post-judgment interest. They are being represented by Charles M. Johnstone II and Jamie F. Little.

The cases have been assigned to Circuit Judges Paul Zakaib Jr., James C. Stucky, Charles E. King, Carrie Webster and Louis H. Bloom.
