CHARLESTON -- A Kanawha County man is suing his former employer after he claims he was injured on the job.
Gregory A. Schott was employed by Petroleum Transport and Petroleum Products from April 19, 2006, until May 25, according to a complaint filed Sept. 7 in Kanawha Circuit Court.
Schott claims on Feb. 25, 2010, he was ordered by Chad Brown, an employee of the defendants, to perform his job duties using a flatbed trailer that was unsafe and had been "red tagged" to due a previous driver having been injured using the trailer.
When Schott refused to use the trailer, he was told he would be fired if he did not use it, according to the suit.
Schott claims while unloading cargo from the unsafe flatbed trailer, he was injured.
By requiring Schott to use an unsafe flatbed trailer, the defendants placed him in an unsafe working condition that presented a high degree of risk and a strong probability of serious injury, according to the suit.
Schott claims the defendants' negligence caused his injuries and violated state and federal policies.
After he was injured, Schott filed a workers' compensation claim and was terminated from his employment for doing so, according to the suit.
Schott is seeking compensatory and punitive damages. He is being represented by Michael J. Del Giudice.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
