Accounting firm sued by two companies for breach

WINFIELD -- Two companies are suing Gibbons & Kawash, A.C. for failing to adequately perform accounting services and breach of contract.

In May, Baltic Capital, Inc., and Macatac Management Services, Inc., executed an engagement letter with the defendant for accounting services, according to a complaint filed Oct. 11 in Putnam Circuit Court.

The plaintiffs claim the defendant failed to comply with the requirements of the agreement and failed to adequately perform accounting services.

Gibbons & Kawash prepared and drafted the engagement letter after an extensive review and bid process and, following the execution of the letter, failed to comply with its requirements by attempting to force the plaintiffs to pay additional sums and fees not specified in the engagement letter, according to the suit.

The plaintiffs claim Gibbons & Kawash has breached the contract by failing to provide adequate accounting services.

As a result of the defendant's breach of contract, the plaintiffs have been and continue to be harmed and have sustained economic loss, according to the suit.

The plaintiffs are seeking compensatory damages with pre- and post-judgment interest. They are being represented by J. Robert Leslie.

The case has been assigned to Circuit Judge O.C. Spaulding.
