Putnam woman blames PJ's Preschool & Daycare for injuries

CHARLESTON -- A Putnam County woman is suing PJ's Preschool & Daycare for injuries she sustained during an exercise class.

PJ's Preschool & Daycare is formally known as PJ's Preschool & Daycare and Haircare, LLC and is doing business as PJ's Fitness Center.

On Feb. 1, 2010, Rhonda Wheeler attended an aquatic Zumba class on the defendant's premises, according to a complaint filed Jan. 31 in Kanawha Circuit Court.

Wheeler claims after participating in the class, she slipped and fell in the women's locker room due to the unsafe condition of the floor.

The defendant had notice or constructive notice of the unsafe condition of the locker room floor, but did nothing to remedy the hazard or warn customers of the condition, according to the suit.

Wheeler claims she suffered severe injuries to her knee, shoulder and other areas of her body and was transported to the hospital by ambulance, where she had to undergo multiple painful surgeries.

The defendant had a duty of reasonable care to provide a safe locker room floor and failed to do so, according to the suit.

Wheeler is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Tanya Hunt Handley.

The case has been assigned to Circuit Judge Tod J. Kaufman.
