Former employee accuses Amedisys of age discrimination

MORGANTOWN – A former employee claims Amedisys Holding, LLC, terminated her employment because of her age.

Tiffany Jones, individually and in her capacity as area vice president for Amedisys Holding, LLC, was also named as a defendant in the suit.

Pamela McCauley was employed by Amedisys as a clinical manager from January 2009 until Sept. 24, according to a complaint filed in Monongalia Circuit Court.

McCauley claims on Sept. 24, Jones terminated her employment and retained another younger individual to do the work she had previously done and at a rate of pay substantially lower than what she had been paid.

The termination of McCauley’s employment was based upon her age, which is in violation of the West Virginia Human Rights Act, according to the suit.

McCauley claims her age was a determining, motivating and substantial factor in the defendants’ decision to terminate her employment in order to employ a younger person at a lower pay to do her job.

The defendants’ conduct was willful, deliberate, intentional and/or undertaken in disregard for the rights and sensibilities of McCauley, according to the suit.

McCauley is seeking compensatory and punitive damages. She is being represented by J. Bryan Edwards.
