CHARLESTON – A Conklin, N.Y., woman is suing One Stop, Inc., after she claims she was injured on its property.
OSI, Inc. and Smith O.V. & Sons, Inc., were also named as defendants in the suit.
On Dec. 27, 2010, Angel Dawson was conducting business on One Stop and OSI’s property, which is owned by Smith O.V. and Sons, according to a complaint filed Dec. 21 in Kanawha Circuit Court.
Dawson claims she proceeded to step up on the curb to access the air compressor vending machine so that she could put air in her vehicle. However, when she stepped down from the curb, she slipped and fell on fresh snow and ice.
The defendants failed to maintain the area in which she fell by not treating the area for ice, according to the suit.
Dawson claims the defendants’ negligence caused her to suffer great bodily injury and incur expenses for medical care and attention.
The defendants also caused her to suffer great bodily injuries, some of which are permanent and lasting in nature, according to the suit.
Dawson is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Michael A. Turkaly.
The case has been assigned to Circuit Judge Tod J. Kaufman.
