FAYETTEVILLE - An Oak Hill woman is suing after her tree was allegedly damaged by a landscaping company.
Kathleen Fitzpatrick filed a lawsuit in the Circuit Court of Fayette County on Oct. 24 against Judy Kuhn and John's Tree and Landscaping Inc.
The plaintiff says on June 20, defendant Kuhn hired and directed John's Tree and Landscaping to cut down an old tree that Kuhn knew was on the plaintiff's property.
John's Tree and Landscaping performed no due diligence to ascertain the owner of the tree before beginning to remove it, according to the complaint.
The plaintiff is seeking the replacement cost of the tree plus additional damages. She is being represented in the case by Fayetteville attorney Larry E. Harrah II.
