BECKLEY -- A woman is suing a gas station/convenience store where she was allegedly injured after stepping in a pothole by a gas pump.
Deborah Baker filed a complaint June 26 in Raleigh Circuit Court against Little General Store Inc. On June 9, Baker's original complaint was dismissed because she didn't file it within 120 days. Now she's filing again within one year of the dismissal, as allowed by law.
On April 5, 2013, the lawsuit states, Baker was at Little General Store in MacArthur to gas up her vehicle, when she stepped in a pothole near the pump that was hidden from view.
According to the lawsuit, the defendant is cited with failing to maintain and safe store; warn customers about an unsafe condition; and properly maintain its parking lot.
The plaintiff, as a result, suffered "severe trauma to her back, legs and knees, and other parts of her body," as well as pain and suffering, and medical expenses, the lawsuit states.
She seeks unspecified punitive damages, attorney's fees and court costs.
