BECKLEY -- A speech pathologist is asking the court to reverse a decision made by a state board to revoke her license.
Elissa G. Lindsay filed a petition for judicial review June 4 in Raleigh Circuit Court.
Lindsay is asking the court to reverse the decision made by the West Virginia Board of Examiners for Speech-Language Pathology and Audiology on May 5 that resulted in economic hardship and her license as a speech-language pathologist being revoked.
According to the petition, the board determined that Lindsay's actions concerning a certain case "constituted misconduct;" however, Lindsay contends that the board's decision meted out "excessive punishment."
The matter concerns Lindsay telling a client that she "absolutely had no time" to handle the therapy of a woman, the lawsuit states. Lindsay emphasizes that she was referring to her lack of time to handle the additional case load.
The plaintiff asks the court to reverse the board's decision and reinstate her license to continue her career.
